General Terms and Conditions for Balloon Installations

Definition of balloon installations : By “balloon installations” we mean all balloon garlands, balloon columns, wedding balloons, helium bubbles, pop-up balloons, infinity bubbles, personalized balloons, helium-filled balloons (foil and latex balloons) and balloon bouquets that we provide – in other words, all balloon products that have been filled, personalized or otherwise processed by us.

A. Adhesion and durability

  1. No guarantee of durability : We do not guarantee the durability of balloon installations, whether indoors or outdoors. Balloons are made of natural latex and are therefore a natural product. Latex balloons change over time when they come into contact with oxygen and light. They become matte, can shrink, change color and in some cases burst spontaneously. Foil balloons and bubbles lose helium or air over time, which is a normal process. Applied lettering becomes wavy over time due to the natural shrinkage of the balloon. No statement can be made about the duration of the durability, as many different factors (such as weather, temperatures, air pressure, handling and environmental influences) play a role, so an exact prediction is not possible. These natural changes are subject to the laws of nature and physics and are beyond our control or influence. Since we can neither predict nor control what happens to the balloons after installation, we accept no liability for durability, appearance, material properties or other unforeseeable influences.
  2. Disclaimer : We accept no liability for damage, changes or premature dismantling of the balloon installation due to unforeseen circumstances, improper handling, environmental influences, third parties or other circumstances for which we are not responsible. In particular, for outdoor installations, we accept no liability for weather-related damage (e.g. wind, rain, sunlight).

B. Contract and Services

  1. Service, not a work contract : This is a service contract, not a work contract. Our service includes the construction of the balloon installation as well as the necessary time and material. The effort for planning, preparation and implementation is also taken into account and calculated accordingly. After completion of the construction, delivery or collection (depending on the order), the service is considered to have been fully provided.
  2. Use of the installations : Balloon installations are intended for one-off occasions and short-term use. They are not suitable for long-term use. Changes to the installation after assembly are only possible for an additional charge. Requests for changes made after the final approval of the installation concept or after acceptance are considered additional services and are invoiced separately.
  3. Change requests after installation : Changes or additional requests after installation is complete will only be implemented at an additional cost as this will require additional labor and possibly new material.
  4. Maintenance and care of the installation : After completion and acceptance of the balloon installation, the responsibility for its care and proper handling rests entirely with the customer. Direct sunlight, extreme temperatures, wind or sharp objects in the vicinity can shorten the life of the balloons. Any weather conditions, including rain and especially sudden weather changes such as temperature fluctuations, can affect the balloon installation. Even if these fluctuations are not immediately noticeable, the balloons are constantly exposed to these influences. We accept no liability for damage or changes that occur to the installation after acceptance, regardless of the external influences or handling.

C. Payments, cancellations and additional costs

  1. Advance payments : For larger installations, a deposit of up to 50% of the total price may be required. This deposit is non-refundable if the cancellation is made within two weeks of the scheduled installation date. For smaller installations, the full amount is due upon placing the order. Classification into smaller or larger installations is at our discretion.
  2. Cancellations and rescheduling : Since we have to order the balloons long before the installation date, cancellation after the order has been placed is no longer possible free of charge. In this case, costs of 25% of the total price will be incurred. Up to two weeks before the planned installation, cancellation fees of 50% will be incurred, as the estimated income and the keeping of the date free have already been planned. Rescheduling that takes place less than two weeks before the planned installation will also be treated as cancellations.
  3. Additional costs for unforeseeable additional work : Should unforeseeable circumstances arise during installation that require additional work, we reserve the right to invoice these additional costs separately.
  4. Transport and assembly costs : We charge transport and assembly costs for each installation, which are agreed separately depending on the distance to the event location and the amount of work involved. Dismantling costs are not included in the price. If the customer wishes to dismantle the installation, this will be charged separately. If the customer undertakes the dismantling themselves, we accept no liability for damage that occurs during dismantling.
  5. Default in payment : If the customer defaults on payment, we are entitled to charge interest on arrears at a rate of 5% above the current base interest rate of the European Central Bank. In addition, we reserve the right to charge reminder fees and to withhold further execution of orders until payment has been made.

D. Complaints and Acceptance

  1. Exclusion of subsequent complaints : The service is deemed to have been fully provided upon completion of the installation, delivery or collection by the customer. The customer has the opportunity to report any defects immediately after completion of the installation, delivery or collection. We will examine these and, if necessary, carry out rework within the scope of the order. Subsequent complaints or price reductions made after completion of the installation, delivery or collection will not be accepted.
  2. Waiting times and acceptance in the event of absence : The customer is obliged to be available at the agreed time of completion. If the customer is not present or cannot be reached at the time of completion, a waiting time of €30 net per half hour or part thereof will be charged. If the customer cannot or does not want to be present, he can appoint a representative to carry out the acceptance on his behalf. If no representative is appointed, the balloon installation is deemed to have been tacitly accepted. Regardless of this, we document the finished work with photos and, if requested, send these to the customer in digital form.

E. Miscellaneous

  1. Delays due to unforeseen circumstances : We cannot be held responsible for delays caused by unforeseen circumstances such as delivery delays, extreme weather conditions or force majeure. In such cases, we reserve the right to change the installation time in consultation with the customer.
  2. Photo rights/usage rights : We reserve the right to use photos and videos of the finished balloon installations as well as the assembly or dismantling for advertising purposes, including social media and websites. If the photos show people who are not the main subject (e.g. by chance in the background), we assume in accordance with Section 23 of the Art Copyright Act (KUG) that no separate consent is required. If you do not want images or videos in which you or your guests are recognizable to be used, please let us know. before the installation or the photography. Personal information or faces can be made unrecognizable upon request. The right to publish the balloon installation as our work remains unaffected.
